RESOLUTION DISCHARGING THE SHERIFF OF SAN MATEO COUNTY FROM ACCOUNTABILITY FOR COLLECTION OF DELINQUENT ACCOUNTS FROM FORMER PARTICIPANTS IN THE SHERIFF'S WORK PROGRAM (SWP)

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Sheriff's Office conducts a Work Program as an alternative to incarceration, and has been authorized to charge certain fees from the participants in the program; and

WHEREAS, in connection with these charges, the Sheriff has incurred delinquent accounts receivable in the amount of $2,295 and all reasonable effort has been made by the Sheriff's Office to collect the delinquent accounts; and

WHEREAS, California Government Code § 25257 provides that any county officer who is charged by law with the collection of money which is due and payable to the county may apply to the board of supervisors for a discharge from accountability for the collection thereof if the amount is too small to justify the cost of collection, the likelihood of collection does not warrant the expense involved, or the amount thereof has been otherwise lawfully compromised or adjusted. the amount is too small or the likelihood of collection does not warrant the expense involved; and

WHEREAS, the cost of collecting these delinquent accounts has exceeded the revenue collected and any further effort to attempt collection would not be cost effective; and

WHEREAS, the Sheriff has requested to be discharged from the responsibility of collecting the accounts and it appears to be cost-effective and in the taxpayers’ best interest to do so.

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT:

    1. The Board of Supervisors shall, and does hereby relieve the Sheriff from accountability for delinquent accounts as more particularly described in Exhibit "A" attached hereto; and

    2. The Clerk of this Board be, and is hereby authorized and directed to send a copy of this Resolution to the County Controller.
