Resolution Authorizing an Increase in Aggregate Payments to the Contractor for Colma Creek Channel Improvements between Spruce and San Mateo Avenues in South San Francisco (Project No. FCC03, F-149 [9R-1])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing board of the San Mateo County Flood Control District, that

 

WHEREAS, this Board, on June 27, 2003, adopted Resolution No. 63823, which awarded and authorized execution of a contract with Northwest Construction for the construction of Colma Creek Channel Improvements between Spruce and San Mateo Avenues; and

 

WHEREAS, an Agreement with Northwest Construction was entered into, as authorized by said Resolution; and

 

WHEREAS, the Agreement provides that aggregate payments to Northwest Construction shall not exceed $12,091,000 without this Board’s approval; and

 

WHEREAS, it is anticipated that the changed conditions in the project will increase the overall contract cost to an amount greater than was originally authorized by this Board; and

 

WHEREAS, the Director of Public Works has recommended that the Not-To-Exceed figure as originally approved by this Board be increased to provide for removal and disposal of contaminated soil which exceeded original estimates; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

The Agreement with Northwest Construction, entered into on June 27, 2003, is hereby amended to provide that aggregate payments to Northwest Construction for said work, shall not exceed the sum of Fourteen Million, One Hundred Ninety-One Thousand and No/100ths Dollars ($14,191,000.00) without this Board’s approval.

 

2.

All other provisions of said Agreement, with exception of the modification as herein provided, shall remain unchanged.
