First Lease Amendment with DLC Foster City, LP and Triton Associates, LLC as Tenants in Common for warehouse space at 1164-1166 Triton Drive, Foster City for temporary storage of records of the Elections Division (Lease No. 1266)

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board of Supervisors to execute a First Lease Amendment ("Amendment") with DLC Foster City, LLP and Triton Associates, LLC as Tenants in Common to extend the term of the lease of temporary warehouse space at 1164-1166 Triton Drive, Foster City.

 

BACKGROUND:

As authorized by Resolution No. 66677, the Assessor-County Clerk Recorder and Chief Elections Officer implemented a temporary relocation of records from 40 Tower Road to 1164-1166 Triton Drive in May 2004. The relocation was necessary in order to accommodate construction activities to reconfigure the Tower Road facility. It was originally anticipated that all work would be completed by July 31, 2004, but it is now anticipated that the work will not be completed until late September or early October of this year.

 

DISCUSSION:

The lease was originally scheduled to terminate as of August 30, 2004. The Amendment extends the term through October 31, 2004. If construction is completed sooner, the lease provides the County the right to terminate at any time by giving the landlord thirty days written notice.

The Chief Elections Officer concurs in this recommendation. County Counsel has reviewed and approved the First Lease Amendment as to form.

 

VISION ALIGNMENT:

The proposed Amendment keeps the commitment of responsive, effective and collaborative government and goal number 20: Government decisions are based on careful consideration of future impact, rather than immediate gain. The lease contributes to this commitment and goal by extending the temporary storage solution that will facilitate an increase in efficiency at the Elections Warehouse for both Elections and HSA.

 

FISCAL IMPACT:

Elections has funds in the 2004/2005 budget for the additional rent of $11,400.
