Approve a Second Amendment to the Agreement with Robert Shaw & Associates

 

Recommendation

Adopt a Resolution authorizing the execution of a Second Amendment to the Agreement with Robert Shaw & Associates for the preparation of the Environmental Review Records (ERR) and National Environmental Policy Act (NEPA) forms. This Amendment is to increase the amount from $90,000 to $170,000. The term of the Agreement remains the same, May 15, 2003 to June 30, 2005.

 

Background

Preparation of the Environmental Review Records (ERR) is a U.S. Housing and Urban Development (HUD) requirement for CDBG and HOME funded projects. These records require a site inspection and details on noise, flooding, historic preservation, explosive/flammable operations and other areas required by HUD regulations. This year additional reports will be needed under the HUD National Environmental Policy Act (NEPA) for minor rehabilitation and/or acquisition of existing structures.

 

Discussion

Payments for the preparation of ERRs, NEPA reports and other environmental review documents as needed are based on a time and material basis.

 

The original Agreement amount and subsequent First Amendment amount were estimated to be sufficient to have Contractor complete the ERRs, NEPA reports and to create and coordinate a Programmatic Agreement with the State Historic Preservation Office. However, due to increased environmental requirements, including the requirement to provide environmental reviews on all sites funded with CDBG funds for Minor Home Repair Programs, such as North Peninsula Neighborhood Services Center, CID, Senior Coastsiders and Rebuilding Together, additional funds need to be added to this Agreement.

 

VISION ALIGNMENT

The Agreement with Robert Shaw & Associates keeps the commitment of: Ensuring basic health and safety for all, and goal number 8: Help vulnerable people - the aged, disabled, mentally ill, at-risk youth and others - achieve a better quality of life. The Agreement contributes to this commitment and goal by providing environmental assessments on projects which will address health and safety hazards including but not limited to addressing housing code deficiencies and rehabilitating existing housing stock in San Mateo County in addition to preserving the integrity of historic housing.

 

FISCAL IMPACT

The term of this Agreement is May 15, 2003 to June 30, 2005. This Second Amendment adds $80,000 from CDBG, bringing the total amount of this Agreement to $170,000, and is included in the Office of Housing Recommended Budget for FY 2004-05. There is no Net County Cost.
