Resolution Authorizing Execution of an Agreement for the Installation of a Landscaping Wall - Lands of Mitchell and Roberts - Miramar Area of the MidCoast

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Michael Mitchell and Diana Roberts (Permittees), the owners of the property adjacent to Alameda Avenue and Mirada Road, have requested an Encroachment Permit to install and maintain a landscaping wall and trees in the Alameda Avenue and Mirada Road rights-of-way; and

WHEREAS, Permittees have agreed to execute a recorded agreement to maintain, repair, relocate or remove said encroachments at Permittee’s expense upon demand of County; and

WHEREAS, the Director of Public Works has recommended that an agreement between the County and Permitees be executed and this Board has considered the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED, that said Agreement by and between the County of San Mateo and Michael Mitchell and Diana Roberts is hereby approved, and the President of this Board is hereby authorized and directed to sign said agreement for and on behalf of the County of San Mateo.
