RESOLUTION AUTHORIZING A WAIVER OF THE REQUEST FOR PROPOSAL PROCESS AND EXECUTION OF A THRID AMENDMENT TO THE AGREEMENT WITH MARTIN L. FORST

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on December 28, 2001 the County Manager’s Office waived the Request for Proposal Process and entered into Agreement with evaluator Marin L. Forst for the term of July 1, 2001 through June 30, 2004 for the amount of $45,000; and

WHEREAS, this Agreement has been amended on two previous occasions for the purpose of extending services to June 30, 2005 and increasing the amount by $64,000 for a total obligation of $109,000; and

WHEREAS, the parties wish to further amend the Agreement for the purpose of increasing funds by $46,500 making the total obligation of the Agreement $155,500 and extend the term to June 30, 2007 for the purpose of continuing evaluation services under Proposition 99 and MSA, to extend evaluation services under the Youth Coalition to February 28, 2005 only, and evaluation services under the Young Adult Grant will continue to expire June 30, 2005; and

WHEREAS, Human Services Agency is requesting that the Board of Supervisors waive the RFP Process for the purpose of extending the Agreement with Martin L. Forst to June 30, 2007. Martin L. Forst is specified as the evaluator for tobacco prevention services by the CDHS/TCS grant and the Proposition 99 Allocation Agreement; and

WHEREAS, this Board has been presented with a form of such Third Amendment to the Agreement and said Board has examined and approved same as to both form and content and desires to enter into the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized to waive the Request for Proposal Process and directed to execute said Third Amendment to the Agreement for and on behalf of the County of San Mateo; and the Clerk of this Board shall attest the President's signature thereto.
