Disposition of Claims Filed Against County

Recommendation:
Deny the claims listed below.

Background:
Under authority of Resolution No. 35006 and Ordinance No. 2321, the Board directed the Director to process claims filed against the County. Further investigation may indicate justification for payment by the County. If so, payment will be made under the authority of the Risk Manager or will be brought back to the Board.

The Risk Management Division has reviewed these claims and recommends that you take the following action:

		Claimant alleges he was stopped from obtaining his G.E.D and growth from the CHOICE'S Program.

		Claimant alleges conspiracy by jail staff and continued harassment have caused mental anguish, severe emotional stress and duress.

		Claimant alleges bias and discriminatory damages by deputies at the Maguire Jail.
G03-143		Johnson, Tavis	6/23/04 Non-culpable
		Claimant alleges he was denied access to the law library before his parole hearing causing him to be incarcerated for 10 months.

		Claimant alleges injuries and damages to his real property located at 53 Westpark Drive in Daly City are the result of the dangerous condition that was negligently and carelessly owned, and maintained by County of San Mateo.

		Claimant alleges pain and suffering due to being arrested for an invalid warrant by law enforcement.

		Claimants allege injuries due to his vehicle being hit in the rear by a County of San Mateo driver.

		Claimant alleges while at Memorial Park, a tree fell down onto campsite damaging her personal property.

		Claimants allege a County of San Mateo vehicle backed into their legally parked car.

M04-004		Stiles, Georgina	8/20/04 Non-culpable
		Claimant alleges lost personal property while in the Radiology Unit of the San Mateo County Medical Center.

G03-138		Vega Sr., Vince G.	3/11/04 Non-culpable
		Claimant alleges he was assaulted by an off duty East Palo Alto police sergeant and suffered injuries.
