RESOLUTION AUTHORIZING THE EXECUTION OF A BASIC ORDERING AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE FEDERAL BUREAU OF INVESTIGATION FOR USE OF SPACE IN A COUNTY BUILDING FOR A COMMUNICATION FACILITY AT PISE MOUNTAIN, CALIFORNIA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Basic Ordering Agreement, reference to which is hereby made for further particulars, whereby the County of San Mateo will allow the Federal Bureau of Investigation (FBI) to maintain and operate a communication facility at Pise Mountain for $935.73 per month, with annual increases in the amount of 3% in accordance with the terms and conditions contained in said agreement; and

 

WHEREAS, the Basic Ordering Agreement is for a term commencing October 1, 2004 and expiring September 30, 2005, subject to the right of the FBI to renew the agreement annually through September 30, 2014 with either party having the option to terminate upon three months prior written notice; and

 

WHEREAS, this Board has been presented with the Basic Ordering Agreement and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Basic Ordering Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or designee is hereby authorized to accept or execute on behalf of the County, any and all, amendments, options, notices, consents, approvals, terminations and documents in connection with the Basic Ordering Agreement, except as otherwise provided by applicable law, including the County's Ordinance Code and Charter.
