Grant of Driveway Easement Over Property at 1 Mirada Road in Unincorporated Half Moon Bay (COP 2684)

 

Recommendation

Accept an Easement Grant Deed from James Michael Powers and Diana E. Venegas-Powers for driveway ingress and egress over a portion of their property located at 1 Mirada Road in the unincorporated area of Half Moon Bay.

 

Background

In 2003, the County of San Mateo made improvements to the bridge over Medio Creek that limited street access to the property at 445 Mirada Road, adjacent to the Powers’ property at 1 Mirada Road. The easement is intended to restore adequate access to and benefit the property at 445 Mirada Road, which was impaired by the bridge reconstruction.

 

Discussion

The easement deed is presented for the Board's acceptance. Under the terms of the contract, the owners of 1 Mirada Road will provide shared driveway access to the owners of 445 Mirada Road via an easement for ingress and egress. The easement area is approximately 124 square feet in size but will reduce the parking at 1 Mirada Road by one space and cause the owners to share an entrance to their properties.

The Real Property Services Division has negotiated the just compensation for the taking at $25,000. This represents a relatively nominal amount compared with the total value of this unique commercial property.

 

The Director of Public Works concurs in this recommendation. County Counsel has reviewed the agreement as to form.

 

Vision Alignment

Acceptance of the Easement Grant Deed keeps the commitment of responsive, effective and collaborative government and goal number 20: Government decisions are based on careful consideration of future impact, rather than temporary relief or immediate gain. Acceptance of the Easement Grant Deed contributes to this commitment and goal by curing a private property defect caused by a public project.

 

Fiscal Impact

Funds for the acquisition of this easement are available from the Department of Public Work's ½ Cent Transportation funding source.
