Resolution Authorizing the Director of Public Works to Submit an Application for Federal Surface Transportation Program Funding for the Pescadero Creek Road Resurfacing Project from Dearborn Park Road to 1.5 Miles West of Dearborn Park Road

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Transportation Equity Act for the 21st Century (TEA-21) (Public Law 105-178, June 9, 1998) and the TEA-21 Restoration Act (Public Law 105-206, July 22, 1998), continues the Surface Transportation Program (23 U.S.C. § 133); and

 

WHEREAS, the TEA-21 legislation will guide the programming of various Federal highway programs until a TEA-21 Reauthorization bill is authorized; and

 

WHEREAS, pursuant to TEA-21 and the regulations promulgated thereunder, eligible project sponsors wishing to receive Surface Transportation Program (STP) funding for a project must first submit an application to the appropriate Metropolitan Transportation Planning Organization (MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP); and

 

WHEREAS, the Metropolitan Transportation Commission (MTC) is the MPO for the San Francisco Bay Region; and

 

WHEREAS, the County of San Mateo is an eligible project sponsor for STP funding; and

 

WHEREAS, the City/County Association of Governments has programmed $310,000 from STP funds as a reimbursement for Transit Oriented Development (TOD) Incentive Program; and

 

WHEREAS, the Director of Public Works has recommended that the County submit an application to MTC for funds from the STP in Fiscal Year 2004-05 for the resurfacing of Pescadero Creek Road from Dearborn Park Road to 1.5 Miles West of Dearborn Park Road; and

 

WHEREAS, MTC requires, as part of the application, a resolution stating the following:

 

The commitment of necessary local matching funds; a statement that the sponsor understands that the STP program funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with STP program funds; the assurance of the sponsor to complete the project as described in the application, and if approved, as programmed in MTC’s TIP; and

 

WHEREAS, Attachment “A” attached hereto and incorporated herein, includes the certification of assurances by the County of San Mateo for the Resurfacing of Pescadero Creek Road from Dearborn Park Road to 1.5 Miles West of Dearborn Park Road.

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED that:

 

A.

The Director of Public Works is authorized to execute and file an application, which includes the certification of assurances (Attachment “A”), for funding under the STP of TEA-21 Reauthorization in the amount of $310,000 for 2004-2005 to help finance the cost of resurfacing Pescadero Creek Road from Dearborn Park Road to 1.5 Miles West of Dearborn Park Road.

 

B.

This Board will provide $100,000 in non-Federal matching funds for the project.

 

C.

This Board is aware that the STP funding for the project is fixed at $310,000, that any cost increases must be funded by the County from local matching funds, and that this Board does not expect any cost increases to be funded with STP funds.

 

D.

The funds will be used to resurface the streets as described in this resolution and for the amount shown in the Metropolitan Transportation Commission (MTC) Transportation Improvement Program (TIP), if the project is approved, with obligation occurring within the timeframe established as described below.

 

E.

The program funds are expected to be obligated by June 30th of the year the project is programmed in MTC’s TIP.

 

F.

The County is an eligible sponsor of STP projects.

 

G.

The County is authorized to submit an application for STP funds for the Resurfacing of Pescadero Creek Road from Dearborn Park Road to 1.5 Miles West of Dearborn Park Road.

 

H.

There is no legal impediment to the County making an application for STP funds.

 

I.

There is no pending or threatened litigation which might in any way adversely affect the proposed project or the ability of the County to construct said project. There is, likewise, no known controversy surrounding this project, which may prevent its timely completion.

 

J.

The Director of Public Works is hereby directed to file a copy of this resolution with MTC together with the application for grant funds.

 

K.

MTC is requested to support the application for the project described in the resolution and to program the project in MTC's TIP.
