FIRST AMENDMENT TO AGREEMENT NO. CMO 04 07A WITH THE PHILLIPS GROUP FOR INSPECTION SERVICES FOR THE SAN MATEO COUNTY YOUTH SERVICES CENTER PROJECT

This Amendment to Agreement, made and entered into this ________ day of ______________, 2004, by and between the COUNTY OF SAN MATEO, a political subdivision of the State of California, hereinafter called the County, and The Phillips Group hereinafter called Contractor.

WITNESSETH

WHEREAS, On July 14, 2004, the parties hereto entered into Agreement No. CMO 04 07A for inspection services for the San Mateo County Youth Services Center project in the amount of $78,000; and

WHEREAS, the Agreement was an estimate of services to be needed and required; and

WHEREAS, it is necessary to increase the amount and time of the contract to continue inspection services;

NOW THEREFORE, the County and Contractor agree to: Increase the maximum not-to-exceed total payment for additional services of Contractor by $232,400 from $78,000 to $310,400 and extend the term of the contract from January 6, 2005 through December 31, 2006. The hourly rate for the period January 6, 2005 through June 30, 2005 is $75/hour for straight time and $95/hour for work in excess of 40 hours per week. From July 1, 2005 through December 31, 2006 the hourly rate will be $80/hour for straight time and $100/hour for work in excess of 40 hours per week.

In all other respects, the Agreement shall remain in full force and effect.
