Recommendation

Adopt a resolution delegating to the Director of Public Works and the County Manager, or their designees, the authority to sign and record notices of completion on behalf of the County of San Mateo.

 

Background

At the conclusion of construction projects, it is typical for the owner or the owner’s agent to sign and record a Notice of Completion, which notice triggers the time requirement within which contractors and sub-contractors may/can submit claims. It is in the best interest of the county to sign and record Notices of completion in a timely manner, so that claims may be resolved as expediently and efficiently as possible and without undue delay.

Discussion

County construction projects are administered by either the County Manager, the Director of Public Works, or their designees. In administering the projects, those county officers are acting as agents of the county, which is the owner of the property. The delegation of authority to sign and record Notices of Completion to the County Manager or the Director of Public Works would be efficient and would enable the timely resolution of construction claims against the county.

 

It is recommended that the Director of Public Works or the Director’s designee is authorized and directed to sign and record Notices of Completion for county construction projects that are administered by the Department of Public Works, and that the County Manager or the Manager’s designee is authorized and directed to sign and have recorded record Notices of Completion for county construction projects that are not administered by the Department of Public Works.

 

Fiscal Impact

The delegation could have the effect of minimizing untimely claims from contractors and subcontractors, the impact of which would vary depending on the size of the construction contract in question.

The resolution keeps the commitment to responsive, effective and collaborative government, in that it will implement a strategic approaches to issues affecting the whole county.
