RESOLUTION AUTHORIZING THE EXECUTION OF A SECOND LEASE AMENDMENT BETWEEN THE COUNTY OF SAN MATEO AND COYOTE POINT YACHT CLUB, INC. AT COYOTE POINT PARK, SAN MATEO, CALIFORNIA

(LEASE NO. 5025)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on September 16, 1967 the County of San Mateo and Coyote Point Yacht Club, Inc. as authorized by Resolution No. 24252, entered into a Lease Agreement for the lease of real property at Coyote Point Park, San Mateo, California; and

 

WHEREAS, on October 5, 1993 the County of San Mateo and Coyote Point Yacht Club, Inc., as authorized by Resolution No. 57634, entered into a First Amendment to Lease; and

 

WHEREAS, the parties wish to further amend the Lease to extend the term through September 15, 2024 at a monthly rent of $1,308.00, which rent will increase annually on the anniversary date in proportion to any increase in the Consumer Price Index, and requiring the Tenant to make certain improvements to the premises, including those necessary to comply with the Americans with Disabilities Act; and

 

WHEREAS, this Board has been presented with the Second Lease Amendment and has examined and approved same as to both form and content and desires to enter into same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

    1. That the President of the Board of Supervisors be, and is hereby, authorized and directed to execute said Second Lease Amendment for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto; and

    2. That the County Manager and or his designee is hereby authorized to accept or issue on behalf of the County, any and all amendments, options, notices, consents, approvals, terminations and documents in connection with the Lease, except as otherwise provided by applicable law, including the County’s Ordinance Code and Charter.
