RESOLUTION APPROVING THE CONFLICT OF INTEREST CODE OF THE CENTRAL COUNTY FIRE DEPARTMENT AND THE AMENDED CONFLICT OF INTEREST CODES OF COUNTY AGENCIES , SPECIAL DISTRICTS, SCHOOL DISTRICTS, AND COUNTY DEPARTMENTS, BOARDS AND COMMISSIONS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Political Reform Act of 1974 requires every public agency to adopt and promulgate a Conflict of Interest Code, designating employees who must file annual conflict of interest statements;

 

WHEREAS, the Central County Fire Department, a Joint Powers Authority whose members are the Town of Hillsborough and the City of Burlingame, was created and has adopted a Conflict of Interest Code which must be approved by the San Mateo County Board of Supervisors;

 

WHEREAS, the Central County Fire Department has submitted a copy of its Conflict of Interest Code for approval;

 

WHEREAS, the Political Reform Act of 1974 further requires that each agency review their Conflict of Interest Codes every two years;

 

WHEREAS, public agencies must amend their codes to address changed circumstances such as when new positions have been added or eliminated or the duties of positions have changed; and

 

WHEREAS, some of the proposed codes submitted by agencies listed on Exhibit A designate someone other than the County Clerk as the Filing Officer and those codes should be revised by the Board of Supervisors to provide that the County Clerk be the Filing Officer and the Board such authority to make such revision pursuant to Government Code §87303(b); and

 

WHEREAS, each such agency, as listed in Exhibit A, attached hereto, has reviewed its code and has submitted an amended code to the Board for approval.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

 

    1. The Conflict of Interest Code submitted by the Central County Fire Department (Exhibit B), is hereby approved.

    2. Any Conflict of Interest Code of the agencies listed in Exhibit A that has been amended to reflect a new Filing Officer are revised to restore all Filing Officer duties to the County Clerk-Recorder. The code amendments submitted by each agency, listed in Exhibit A, are hereby approved as revised.

    3. The code amendments submitted by all other agencies listed in Exhibit A are hereby approved.

    4. Each designated employees and board members of the Central County Fire Department shall, within 30 days, file all Statements of Economic Interests (Form 700) with their agency. The agency shall make and retain a copy and forward the original to the County Clerk who shall be the filing officer.

    5. Any employee and/or board member who are added to an agency’s list of designated filers as a result of a code amendment shall file an Assuming Office Statement (Form 700) within 30 days of the date which the County Clerk notifies his or her agency of this Board’s approval of its amended code.

    6. Any employee and/or board member that is removed from an agency’s designated list of filers as a result of a code amendment shall file a Leaving Office Statement (Form 700) within 30 days of the date which the County Clerk notifies his or her agency of this Board’s approval of its amended code.

    7. Each designated employee shall file all annual statements of economic interest with the employee’s agency. The agency shall make and retain a copy and forward the original to the County Clerk.

    8. The County Clerk shall be the official responsible for receiving and retaining statements of economic interests submitted by all county departments, boards, commissions, school districts and special districts, with the exception of cities and city agencies.
