Resolution Authorizing Execution of an Agreement to Allow a Driveway to Remain in the Upland Road Right-of-Way – Oak Knoll Manor Area – Lands of Preston III

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Forest Preston III (Preston), is the owner of real property located at 412 Upland Road, County Road No. 407, located in the Oak Knoll Manor Area of San Mateo County; and

WHEREAS, Preston has requested the issuance of an encroachment permit to allow a driveway approach (encroachment) to remain in the Upland Road right-of-way adjacent to Prestons’s property; and

WHEREAS, there has been presented to this Board a form of agreement which provides for said encroachment and which obligates Preston and subsequent owners of the property to maintain, repair, relocate or remove said encroachment at his expense upon demand of County; and

WHEREAS, this Board has considered said agreement.

NOW, THEREFORE, BE IT RESOLVED, that said Agreement by and between the County of San Mateo and Forest Preston III is hereby approved, and the President of this Board of Supervisors is hereby authorized to execute said agreement on behalf of the County and the Clerk of this Board shall attest to the President’s signature thereto.
