BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE SAN MATEO COUNTY TRANSIT DISTRICT, FOR A 3.5-YEAR PERIOD THROUGH JUNE 30, 2008, IN A TOTAL AMOUNT OF APPROXIMATELY $4,716,618

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

WHEREAS, this Board of Supervisors and the Governing Board of the San Mateo County Transit District (SAMTRANS), have previously contracted for for the law enforcement and public safety dispatch services; and

WHEREAS, this Board finds that it is now necessary and desirable that a new Agreement be executed for the provision of law enforcement, security, investigation, and public safety communications services to SAMTRANS, for a three-and one-half-year period of January, 2005 through June, 2008 with full reimbursement to County of the costs of said services, which are approximately $4,716,618 across the contract term, and the management of SAMTRANS do also find the same and are recommending same, and

WHEREAS, this Board finds that it is in the interests of public safety that the Sheriff and the Director of Employee and Public Services of San Mateo County be empowered to execute Amendments to said new Agreement, so as to respond quickly to emerging law enforcement and homeland security situations at the request of SAMTRANS administration, provided said Amendments do not result in any cost to the County’s General Fund; and

WHEREAS, this Board has been presented with a form of said Agreement, with a total contractual reimbursement of approximately $4,716,618 over the specified contract period, and has examined it as to both form and content and desires to enter into same:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT: the President of this Board be, and he is hereby authorized and directed to execute said Agreement between the County of San Mateo and SAMTRANS for and on behalf of the County, and the Clerk of the Board shall attest his signature thereto.

BE IT FURTHER RESOLVED THAT: the Sheriff or his designee, and additionally, where pertaining to public safety communications, the Director of Employee and Public Services or her designee, are herby authorized to execute, on behalf of San Mateo County, Amendments for additional services, provided any additional costs incurred on behalf of the County are fully reimbursed by SAMTRANS, and therefore said Amendment(s) do not result in any additional net cost to the County’s General Fund.
