Approve an Agreement with Robert Shaw & Associates for Environmental Review Services

Recommendation

Adopt a Resolution:

 

    1. Authorizing a Waiver to the Request For Proposal process; and

 

    2. Authorizing the execution of an Agreement with Robert Shaw & Associates in the amount of $150,000 for Environmental Review Services for all Department of Housing funded projects for the term of 7/1/2005 through 6/30/2006; and

 

    3. Authorizing the Director of the Department of Housing to execute subsequent amendments and to make minor modifications in the types of services and activities provided by Robert Shaw & Associates under the Agreement, the cumulative cost of which amendments and modifications is not to exceed $25,000.

The Agreement with Robert Shaw & Associates contributes to this commitment and goal by providing environmental assessments on projects which will address health and safety hazards including, but not limited to, addressing housing code deficiencies and rehabilitating existing housing stock in San Mateo County in addition to preserving the integrity of historic housing.

Background

Preparation of the Environmental Review Records (ERR) and National Environmental Policy Act (NEPA) reviews for minor rehabilitation and/or acquisition of existing structures are U.S. Housing and Urban Development (HUD) requirements for CDBG and HOME funded projects. These records require a site inspection and details on noise, flood plains, historic preservation, explosive/flammable operations and other areas required by HUD regulations.

Discussion

The County of San Mateo’s Department of Housing needs to conduct environmental reviews on all housing development and/or acquisition projects in addition to the conducting and reporting of environmental reviews on all sites funded with CDBG funds for Minor Home Repair Programs, such as North Peninsula Neighborhood Services Center, CID, Senior Coastsiders and Rebuilding Together Peninsula.

Payments for the preparation of ERRs, NEPA reports and other environmental review documents as needed, are based on a time and material basis.

The request for a waiver of a Request For Proposal for this Agreement is based on the fact that Robert Shaw & Associates is a sole source provider for the type of services required. Robert Shaw is the only qualified consultant in the area that has the type of experience required to effectively prepare the Environmental Review Records, as required by HUD.

Mr. Shaw is currently working for us under a separate Agreement, which expires June 30, 2005.

FISCAL IMPACT

The term of this Agreement is July 1, 2005 to June 30, 2006. The amount of the Agreement is $150,000 from CDBG, and is included in the Department of Housing Recommended Budget for FY 2005-06. There is no Net County Cost.
