RESOLUTION AUTHORIZING A WAIVER TO THE REQUEST FOR PROPOSAL PROCESS, AND THE EXECUTION OF AN AGREEMENT WITH ROBERT SHAW & ASSOCIATES IN THE AMOUNT OF $150,000 FOR ENVIRONMENTAL REVIEW SERVICES FOR ALL DEPARTMENT OF HOUSING FUNDED PROJECTS FOR THE TERM OF JULY 1, 2005 THROUGH JUNE 30, 2006 AND AUTHORIZING THE DIRECTOR OF THE DEPARTMENT OF HOUSING TO EXECUTE SUBSEQUENT AMENDMENTS AND TO MAKE MINOR MODIFICATIONS IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED BY ROBERT SHAW & ASSOCIATES UNDER THE AGREEMENT, THE CUMULATIVE COST OF WHICH AMENDMENTS AND MODIFICATIONS IS NOT TO EXCEED $25,000

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California (“County”), that

WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of such services to or for County or any Department thereof; and

WHEREAS, U.S. Housing and Urban Development (HUD) has required the preparation of environmental reviews including, but not limited to, Environmental Review Records (ERR) and National Environmental Policy Act (NEPA) forms, for all CDBG and HOME funded projects; and

WHEREAS, it is the best interest of the County to Waive a Request for Proposal process to contract services to conduct HUD Environmental Reviews, based on the fact that Robert Shaw & Associates in the only provider in the area with the experience and availability to provide such services; and

WHEREAS, it is necessary and desirable that Robert Shaw and Associates (“Contractor”) be retained to prepare the Environmental Review Records (ERR) and to complete the National Environmental Policy Act (NEPA) Forms for minor home repair program sites; and

WHEREAS, both parties now wish to enter into an Agreement for Contractor to provide environmental review services for the period of 7/1/2005 to 6/30/2006, for a total payment not to exceed $150,000; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement between the County and Contractor, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

NOW, THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

BE IT FURTHER RESOLVED, that the Request for Proposal process be waived with respect to the services to be provided pursuant to the Agreement with Robert Shaw & Associates and that the Director of the Department of Housing shall be authorized to execute subsequent amendments and modifications to said Agreement during the term of the Agreement, provided however, that such authority is limited to (a) reducing or increasing the County’s maximum fiscal obligation in the event that there is a commensurate reduction or increase in funding received by the County, provided, however, that such increases shall be limited to a total of $25,000; and (b) making changes in the types of services and activities provided by Contractor, provided that the changes have no impact on the County’s maximum fiscal obligation to Contractor.
