RESOLUTION AUTHORIZING THE EXECUTION OF A SECOND AMENDMENT TO THE AGREEMENT WITH GAMBRO HEALTHCARE RENAL CARE, INC., A NEVADA CORPORATION

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on September 9, 2003, the Board of Supervisors by Resolution Number 66259, authorized Agreement in the amount of $400,000 for the term July 1, 2003 through June 30, 2005 for the purpose of providing acute inpatient dialysis services to medically indigent adults at San Mateo Medical Center; and

WHEREAS, on July 27, 2004, the Board of Supervisors, by Resolution Number 66846, authorized a First Amendment to institute a fee for an aborted procedure; and

WHEREAS, the parties wish to further Amend the Agreement by increasing the amount by $37,000 changing the Agreement obligation from $400,000 to $437,000 for the purpose of paying pending invoices incurred due to increased need for services; and

WHEREAS, the Board has been presented with this Second Amendment and desires to enter into same.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Second Amendment to the Agreement for and on behalf of the County of San Mateo; and the Clerk of this board shall attest the President’s signature thereto.
