RESOLUTION (1) AUTHORIZING THE EXECUTION OF AN INTERAGENCY AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE IN-HOME SUPPORTIVE SERVICES (IHSS) PUBLIC AUTHORITY AND (2) AUTHORIZING THE COUNTY MANAGER TO EXECUTE A BUSINESS ASSOCIATE AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE IN-HOME SUPPORTIVE SERVICES PUBLIC AUTHORITY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, IHSS Public Authority regulations require the County to enter into an Interagency Agreement with the IHSS Public Authority;

 

WHEREAS, the parties wish to enter into an Agreement to provide for the In-Home Supportive Services provider components of the San Mateo County Public Authority for the period of July 1, 2005 through June 30, 2008, for a total obligation of $1,566,467;

 

WHEREAS, funding for Fiscal Year 2007-08 is to be determined and brought before this Board for approval; and

 

WHEREAS, this Board has been presented with an Interagency Agreement and has examined and approved it as to both form and content, reference to which is hereby made for further particulars, and desires to enter into the same:

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Interagency Agreement between the County of San Mateo and the In-Home Supportive Services Public Authority is hereby approved, and the President of this Board of Supervisors is hereby authorized and directed to execute the aforesaid Agreement for and on behalf of the County of San Mateo, and the Clerk of the Board shall attest the President’s signature thereto.

 

NOW, THEREFORE, BE IT FURTHER HEREBY DETERMINED AND ORDERED that the County Manager is authorized to execute a Business Associate Agreement between the County of San Mateo and the In-Home Supportive Services Public Authority as required by Federal and State law in accordance with the Health Insurance Portability and Accountability Act of 1996.
