Approval of an Appropriation Transfer Request for the Agreement with Thomas Reid Associates for the Mitigation Monitoring Program at Guadalupe Valley Quarry

 

RECOMMENDATION:

Approve the transfer of $12,907 from unanticipated revenue to Services and Supplies to provide appropriation from which to pay Thomas Reid Associates to carry out a Mitigation Monitoring and Reporting Program (MMRP) for the Guadalupe Valley Quarry.

The contract funded by this ATR contributes to this commitment and goal by providing inspection services to monitor compliance with permit conditions that ensure the protection of the environment.

 

BACKGROUND:

In September 1995, the Board of Supervisors approved the renewal of the Surface Mining Permit for the Guadalupe Valley Quarry for a period of five years. One condition of approval for that permit was the implementation, by the County Planning Division, of a Mitigation Monitoring Report Program (MMRP) to ensure compliance with the permit’s conditions of approval. The County subsequently hired Thomas Reid Associates (TRA) to oversee this program. The County continues to retain the services of TRA for this task.

 

DISCUSSION:

In March 2000, the quarry operator submitted an application for permit renewal as required under the 1995 conditions of approval. At that time, the quarry operator also submitted a proposal to revise the approved reclamation plan for the quarry. This revision proposes to change the end use of the quarry from a light industrial park to a residential subdivision. Development of this end use will require annexation of the project site into the City of Brisbane. The City is currently processing an application for pre-annexation for the quarry. The City anticipates completing this process during the upcoming year. Once the City completes their process, then the County Planning Division will complete their preparation of the appropriate reports and schedule the necessary hearings with the County Planning Commission. Pending completion of this process, the County Planning Division has allowed the quarry to continue to operate under the 1995 conditions of approval. Those conditions require the continued implementation of the MMRP. The current agreement between the quarry operator and the County runs through the end of 2006. This amount of time should be sufficient to allow completion of the permitting process. The additional amount for the contract extension is not to exceed $12,907 that has already been received from the quarry operator. The requested transfer would set up an appropriation from which to pay the consultant.

 

FISCAL IMPACT:

Contract costs are paid for by the developer. There is no net County cost.
