Approve a First Amendment to the Agreement with The Lesley Foundation

 

Recommendation

Adopt a Resolution authorizing the execution of a First Amendment to the Agreement with The Lesley Foundation to add the amount of $101,185, for new total of $266,185 for a Facility Improvement Loan (for sprinkler system installation and related services), for the term of July 1, 2004 through June 30, 2005.

Goal: Help vulnerable people - the aged, disabled, mentally ill, at-risk youth and others - achieve a better quality of life.

 

The Amendment with The Lesley Foundation contributes to this commitment and goal by providing facility improvements and addressing health and safety hazards at the Bonnie Brae Terrace, which provides affordable housing to low and moderate income seniors.

 

The Agreement with The Lesley Foundation preserves 164 affordable senior units.

Background

The Lesley Foundation, a nonprofit, community-based organization maintains and develops affordable housing and related facilities and services for seniors and persons with disabilities, who have low to moderate incomes.

 

On July 6, 2004, the County of San Mateo entered into an Agreement with The Lesley Foundation for a Facility Improvement Loan under Agreement # 066792, in the amount of $165,000.  The aforementioned Agreement was to provide funding for the installation of fire sprinklers and related services at one of the three buildings, which combined provide 164 units of senior housing at Bonnie Brae Terrace in Belmont. 

 

The installation of the fire sprinklers was necessary per a mandate from the South County Fire Authority after a response to a fire that occurred in one of the three buildings on May of 2003.

 

Discussion

The Lesley Foundation originally intended to install the sprinkler system in three phases (one building at a time), but found that it would be much more cost effective to have all three buildings done at the same time.

 

The Lesley Foundation entered into a separate Agreement with the County of San Mateo Office of Housing's nonprofit rehabilitation program to receive funding for the installation of a sprinkler system in a second building. The additional amount of $101,185 under this Amendment will enable The Lesley Foundation to install the fire sprinkler system in the third and final building within the time frame set forth by the South County Fire Authority.

 

This Amendment has been approved by the County Counsel's Office as to form, and meets HUD regulations. Risk Management has reviewed and approved the Contractor’s insurance coverage.

 

Fiscal Impact

The term of the Agreement remains the same, July 1, 2004 through June 30, 2005.
This Amendment increases the amount by $101,185 increasing the total obligation from $165,000 to $266,185, which is being provided by CDBG funds and is included in the CDBG Action Plan for FY 2004-05. This program is included in the Adopted Office of Housing Budget for FY 2004-05. There is no Net County Cost.
