SUBJECT:

Agreement to Allow the Installation of Landscape Related Retaining Walls within the Public Right of Way – Lakeview and Vernal Ways - Emerald Hills Area

 

Recommendation

Adopt a resolution:

1.

authorizing the President of the Board to execute an agreement with Scott Hublou and Amy Faunce (Owners) to allow retaining walls that will facilitate landscape improvements, to be constructed and maintained within the Lakeview Way and Vernal Way rights-of-way, until the rights-of-way are needed for public purposes; and

 

2.

directing the Clerk of the Board to record the agreement after execution.

The proposed agreement will allow the property owners to incorporate and maintain existing foliage as a part of their landscape plans, and requires the property owners to finance and remove their encroachments when the area is needed for a public purpose.

 

Background

The Owners have applied for an encroachment permit to install retaining walls which extend into the Lakeview Way and Vernal Way rights-of-way. Staff has determined that the proposed walls will not impair sight distance for motorists using these roads.

 

Discussion

We believe that it is appropriate to allow the use of this portion of the rights-of-way as no improvements to Lakeview Way and Vernal Way are proposed at this time as the Community Plan for the area provides that road widening will not be done unless requested and paid for by the property owners adjacent to the specific road.

 

A resolution and agreement have been approved as to form by County Counsel and the Owners have executed the agreement.

 

Fiscal Impact

There is no impact to the General Fund or any other fund of the County by your Board authorizing execution of the proposed agreement.
