Sewage Treatment and Transport - Edgewood Sewer Maintenance District – Redwood City/San Carlos Area

 

Recommendation

a)

Acting as the governing Board of the Edgewood Sewer Maintenance District, hereinafter called “Edgewood District,” adopt a resolution authorizing the President of the Board to execute an agreement with:

 
 

1)

Patrick Fellowes, an individual, and Sunset Real Properties, a Limited Liability Corporation, hereinafter collectively called “Developers,” which obligates the Developers to finance all costs associated with creating the Edgewood District and the costs for providing the transport and treatment of sewage from the Edgewood District;

 
 

2)

the City of Redwood City for the transport and treatment of sewage from the Edgewood District; and

 
 

3)

the Emerald Lake Heights Sewer Maintenance District hereinafter called “Emerald District,” for the operation and maintenance of a sanitary sewer in Edgewood Road that will also be used to transport sewage from the Edgewood District.

 

b)

Acting as the governing Board of the Emerald District, adopt a resolution authorizing the President of the Board to execute an agreement with the Edgewood District for the operation and maintenance of a sanitary sewer in Edgewood Road that will also be used to transport sewage from the Edgewood District.

The proposed agreements will provide an interim method of providing this city type service until the area can be annexed to the City of San Carlos as envisioned.

Adopted resolutions approving the Edgewood Estates and Rathgar Court Subdivisions.

 

Ø

Created the Edgewood District to finance the cost of maintaining the sewer collection system that will be financed and constructed by the Developers of the above referenced subdivisions.

 

History

The Edgewood Estates and Rathgar Court Subdivisions are located on the northerly side of Edgewood Road and are within the sphere of influence of the City of San Carlos. It was originally proposed that the area within the subdivision would be provided sewer service by the City of San Carlos as the area is within the sphere of influence of the City of San Carlos. However, the area is not currently adjacent to the city limits of San Carlos and cannot be annexed at this time; and San Carlos, by policy, will not maintain sanitary sewer facilities outside its corporate boundaries.

 

The Edgewood District was subsequently formed to insure that the sewer collection system serving the subdivisions would be maintained. This was determined to be an appropriate interim solution as the enabling legislation that allowed for the creation of the Edgewood District also provides that the district may be dissolved upon annexation of the area to a city.

 

Discussion

The three agreements that we are recommending that your Board approve, provide the funding for the Edgewood District and for the transport and treatment of sewage from the District. The Edgewood District sewer collection system can be detached from the facilities of the Emerald District and the City of Redwood City at such time as the area is annexed to the City of San Carlos or when the City of San Carlos decides to provide sewer service to this area.

 

The Emerald District has an existing sewer main in a portion of Edgewood Road that can be used to transport sewage from the Edgewood District thereby eliminating the need to build a parallel sewer main in the area.

 

The City of Redwood City has agreed to provide for the transport and treatment of sewage from the Edgewood District.

 

The agreements and resolutions have been approved as to form by County Counsel.

 

Fiscal Impact

The Edgewood District/Developers agreement provides that the Developers:

 

a)

will reimburse the department for costs incurred by the County in forming the district and checking sewer improvement plans (currently estimated at $25,000);

 

b)

pay Redwood City connection and capacity fees, sewer service charges and a contingency reimbursement charges for wet weather flow upgrades (currently estimated at $35,910); and

 

c)

pay the Emerald District for a proportionate share of the capital cost of the sewer main that will be used to transport Edgewood District generated sewage to the Redwood City facilities (currently estimated at $36,000).

 

The Developers are also responsible for financing and building the sewer collection system serving the subdivision properties; and subsequent annual sewer service charges will be paid for by the owners of the individual subdivision lots.

 

The other two agreements (Edgewood/Redwood City agreement and the Edgewood/Emerald District agreement) will be financed by the funds the Developers will be providing pursuant to the Edgewood/Developers agreement.
