Resolution Authorizing Execution of Agreements between:

the Edgewood Sewer Maintenance District and Patrick Fellowes, an individual, and Sunset Real Properties, a Limited Liability Corporation;

the Edgewood Sewer Maintenance District the City of Redwood City; and

the Edgewood Sewer Maintenance District and the Emerald Lake Heights Sewer Maintenance District

for the Transport and Treatment and the Payment of Costs Associated with the Collection and Treatment of Sewage from Properties Within the Edgewood Sewer Maintenance District.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing board of the Edgewood Sewer Maintenance District (District), that

WHEREAS, the District was created to provide for the maintenance and transport of the sewage that will be collected from properties within said District; and

WHEREAS, Patrick Fellowes, an individual, and Sunset Real Properties, a Limited Liability Corporation, hereinafter collectively called “Developers,” propose to develop property within said District; and

WHEREAS, Developers as a condition of developing said property are obligated to finance all costs associated with creating said District and for providing for the transport and treatment of sewage from said District; and

WHEREAS, facilities of both the Emerald Lake Heights Sewer Maintenance District and the City of Redwood City can be used to transport and treat sewage from Developers' property within said District; and

WHEREAS, agreements have been developed between the District and the Developers, the District and the City of Redwood City, and the District and the Emerald Lake Heights Sewer Maintenance District, that provide for the payment of costs associated with the District and with transporting and treating sewage from said District; and

WHEREAS, the Director of Public Works has recommended that the agreements be executed on behalf of the District and this Board has considered and concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said agreements for and on behalf of the District and the signature of the Clerk of the Board shall attest thereto.
