Resolution Authorizing the President of the Board to Execute an Agreement with the City of Redwood City for the Exchange of Real Property - Winslow Street/County Government Center - Redwood City Area (F36 [287])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Winslow Street adjacent to the County Government Center was realigned in 1995; and

WHEREAS, said street realignment utilized property owned in fee by the County and resulted in property no longer needed by the City for road purposes; and

WHEREAS, Pacific Gas and Electric Company (PG&E) maintains a high pressure gas main along the street’s previous alignment; and

WHEREAS, the Director of Public Works has recommended that properties be exchanged with the City in recognition of the use or lack thereof of property for road purposes, and that an easement be approved for PG&E’s high pressure gas main, and

WHEREAS, this Board considered and concurred in the recommendation of the Director of Public Works, and previously indicated its intent to exchange said property; and

WHEREAS, Section 25365 of the California Government Code allows a county to exchange any interest in real property with another public agency subsequent to the publication in a local paper of general circulation of the county’s intent to exchange property; and

WHEREAS, notification of the intent to exchange property has been published in the Independent Newspaper Group, a newspaper of general circulation printed and published in this County; and

WHEREAS, there has been presented to this Board a form of Agreement that provides for the exchange of properties as described above and this Board considered said Agreement.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

This Board hereby authorizes the exchange of property; said property being located on Winslow Street in Redwood City and as described in Exhibits “A”, “B”, “D”, and “F” attached hereto.

2.

The President of this Board is hereby authorized and directed to execute said Agreement on behalf of the County of San Mateo and the Clerk of this Board shall attest to the signature of the President thereto.

3.

The Clerk of this Board is hereby authorized and directed to send a certified copy of this resolution and the executed duplicate original of the Agreement to the City Clerk of the City of Redwood City.

4.

The County Manager or his designee is hereby authorized and directed to execute a grant deed or certificate of acceptance on behalf of the County for the properties as stated in the said Agreement.

5.

The County Manager or his designee is hereby authorized and directed to execute an appropriate document memorializing that PG&E has an easement for its high pressure gas main in said properties as provided for in said Agreement.
