Resolution Authorizing an Increase in Aggregate Payments to the Contractor for the Resurfacing of Various Streets in the Emerald Lake Hills and Burlingame Hills Areas (Project No. RA200 - F-36 [380-1A])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on August 31, 2004, adopt Resolution No. 66901, awarding and authorizing execution of an agreement with G. Bortolotto & Co., Inc., for the Resurfacing of Various Streets in the Emerald Lake Hills and Burlingame Hills Areas; and

WHEREAS, the County did enter into an agreement with G. Bortolotto & Co., Inc., as authorized by said resolution; and

WHEREAS, the agreement provides that aggregate payments to G. Bortolotto & Co., Inc., shall not exceed $182,000 without this Board’s approval; and

WHEREAS, changes in the project have increased the overall contract cost to an amount greater than was originally authorized by this Board; and

WHEREAS, the Director of Public Works has recommended that the not-to-exceed figure as originally approved by this Board be increased to provide for unanticipated work; and

WHEREAS, this Board has considered and concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

the Agreement is hereby amended to provide that aggregate payments to G. Bortolotto & Co., Inc. for said work shall not exceed the sum of One Hundred Ninety-Eight Thousand and No/100 Dollars ($198,000.00) without this Board’s approval.

2.

with exception of modification as herein provided, the Agreement with G. Bortolotto & Co., Inc., entered into on August 31, 2004, shall remain unchanged.
