RESOLUTION AUTHORIZING AN AMENDMENT TO THE AGREEMENT WITH MEDISAVE PHARMACIES, INC. DBA KINDRED PHARMACY SERVICES

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, On September 14, 2004, the Board of Supervisors, by Resolution Number 66939, authorized an Agreement in the amount of $150,000 for the term of April 1, 2004 to March 31, 2005 for the purpose of providing pharmacy services to Burlingame Long Term Care, including all medications and IV therapy on a daily and emergency basis; and

WHEREAS, the parties now wish to amend the language referring to a fee for service rate of Average Whole Price - 10% + $3.95 in Exhibit B of the agreement; and

WHEREAS, the rate County pays for pharmaceutical services should be equivalent to the reimbursement rate paid to Medisave Pharmacies, Inc. by the Medi-Cal program at the time the services are rendered. The agreement is being amended to reflect this change; and

WHEREAS, all references to “Pharmacy” in Exhibits A and B of Agreement are amended to read “Contractor”; and.

WHEREAS, the term of the Agreement and the maximum amount of the Agreement remain the same; and

WHEREAS, this Board has been presented with a form of the Amendment to the Agreement and has examined and approved it as to both form and content and desires to enter into the Amendment to the Agreement:

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signatures thereto.
