Amendment to Agreement with G. E. Chen Construction, Inc., for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour

 

RECOMMENDATION:

Adopt a Resolution authorizing an Amendment to the Agreement with G. E. Chen Construction, Inc., for the Noise Insulation Project within the Fourth Quarter 1999 State 65 dB CNEL Noise Contour, increasing the amount by $11,812 to $104,902.

The proposed Amendment contributes to this commitment and goal by providing noise insulation for eligible properties and affected residents.

BACKGROUND:

In 1992, the San Francisco Airport Commission entered into a Memorandum of Understanding with a number of communities, including San Mateo County, to provide funding for insulating homes within the Fourth Quarter 1999 State 65 dB CNEL noise contour. Since that time, the County has insulated 41 houses and 4 churches in the unincorporated Country Club Park area, near San Francisco International Airport. On June 27, 2000, the Board approved an agreement whereby the San Francisco Airport Commission authorized advance funding to San Mateo County to pay the cost of noise insulation up to a maximum of $50,000 for each noise easement obtained from the owners of additional eligible properties. Since then, advance funding has been authorized to pay for the cost of five additional houses owned by four property owners, in the Country Club Park area, to be insulated as part of the Commission’s ongoing efforts to reduce incompatible land uses.

 

DISCUSSION:

On March 11, 2003 the County awarded an agreement to G. E. Chen Construction to serve as the construction contractor to install the required acoustic improvements in the eligible five houses. Implementation of the project was postponed due to a delay in the County receiving the full amount of authorized funds from the Airport Commission. That delay was the result of a significant decline in Airport revenues that hampered the Airport Commission’s ability to meet some of its financial obligations. That issue has now been resolved and the project can now move forward.

 

Since the award of the contract to G. E. Chen Construction, the cost of building materials (i.e. doors, windows, etc.) has increased. The amount of the contract Amendment is based on the monthly Building Cost Index, which is related to the cost of building materials. The amount of the corporate surety bond filed by the contractor will need to be correspondingly increased by the amount of the Amendment.

 

County Counsel has reviewed and approved the Resolution and Amendment as to form.

 

FISCAL IMPACT:

The cost of the proposed Amendment with G. E. Chen Construction is $11,812, increasing the Agreement total to $104,902. This amount will be fully reimbursed by the City and County of San Francisco through the San Francisco Airport Commission (20%) and the Federal Aviation Administration (80% via a federal grant). There will be no direct costs to the County as a result of this Amendment.
