BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND THE CITY OF REDWOOD CITY GRANTING TO THE CITY AN EASEMENT AND LICENSE IN, ON AND OVER A PORTION OF
APN 052-367-010, COMMONLY KNOWN AS 2200 BROADWAY, REDWOOD, CITY, CALIFORNIA, FOR THE RECONSTRUCTION OF THE HISTORIC COUNTY COURTHOUSE AND CONSTRUCTION OF A PUBLIC PLAZA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a cooperative agreement (the “Agreement”), reference to which is hereby made for further particulars, whereby the County of San Mateo grants to the City of Redwood City an easement and license for the use of real property owned by the County for nominal consideration as set forth in said Agreement, and in accordance with the terms and conditions contained therein; and

 

WHEREAS, entering such Agreement will preserve and enhance the historic County Courthouse and the Courthouse Block as an important community asset, and create a community gathering place for the people of the County, and facilitate the reconstruction of the historic southern façade of the Courthouse, and creation of a public plaza (“Courthouse Square”) adjacent to the Courthouse; and

 

WHEREAS, reconstruction of the historic Courthouse and creation of Courthouse Square will enhance the use of the Courthouse as the County Historical Museum; and

 

WHEREAS, in compliance with Government Code Section 25526.6, this Board finds that the conveyance of the easement and license set forth in the Agreement is in the public interest and that the interest in land conveyed will not substantially conflict or interfere with the use of the property by the County; and

WHEREAS, the Agreement commences upon the execution and delivery of the signed Agreement, which date is estimated as May 1, 2005, and runs for a term of fifty-five (55) years from such date; and

 

WHEREAS, the Agreement automatically renews for four additional ten-year terms unless terminated by the City or the County by giving written notice one year prior to any renewal date; and

 

WHEREAS, this Board has examined and approved the Agreement as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or designee is hereby authorized to accept, execute and enter on behalf of the County, any and all amendments, options, notices, consents, approvals, permits, rights of entry, and documents in connection with the Agreement as needed to comply with the intent of this Resolution and the Agreement, including such agreements that effect contiguous County owned property, except as otherwise provided by applicable law, including the County's Ordinance Code and Charter.
