RESOLUTION IMPLEMENTING THE PROVISIONS OF GOVERNMENT CODE §31479.1 IN SAN MATEO COUNTY RELATIVE TO RETIREMENT CREDIT
FOR CITY COUNCIL SERVICE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there are elective and appointed County officials that may have been a City Council member prior to their election or appointment to the County position; and;

WHEREAS, due to the scheduling of elections to County offices and City Council offices, sometimes there is a gap of more than 6 months between the service rendered in the government positions and consequently, those County officers will not receive the same retirement benefits as those officers in which there is less than a 6 month gap in services; and

 

WHEREAS, Government Code §31479.1, provides that that an elective or appointive County official may receive credit for service rendered on a City Council even though such service was not compensated and this Board has the discretion to make §31479.1 effective in this County; and

 

WHEREAS, County officials who served on City Councils for such cities will not receive the same retirement benefits as those officers who served in cities which have such benefits; and

 

WHEREAS, this Board desires to make §31479.1 effective in this County in order to ensure that the benefits available to elected and appointed County officials do not differ on account as to the timing of the election or appointment or whether the City Council had qualifying retirement benefits.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that Government Code §31479.1 shall be operative in the County of San Mateo.
