RESOLUTION AUTHORIZING THE WAIVER OF THE REQUEST FOR PROPOSAL PROCESS AND THE EXECUTION OF A THIRD AMENDMENT TO THE AGREEMENT WITH THE CITY OF SAN CARLOS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County Manager’s Office executed an Agreement with the City of San Carlos on July 1, 2002 for the purpose of administering a daytime shuttle service, provided by Parking Company of America (PCA), to County employees and participants in the PeninsulaWORKs program, in order to safely transport them from the Caltrain station in San Carlos to PeninsulaWORKs San Carlos, which is located in an industrial area; and

 

WHEREAS, this Agreement has been amended on two previous occasions to increase funds by $39,084 and to extend the term to June 30, 2005 to continue shuttle services, however no funds were added in the Second Amendment to pay for such services, and due to changes in staff, there were further delays in adding funds; and

 

WHEREAS, the County and Contractor wish the further amend this Agreement to fund services through June 30, 2005 by increasing the amount by $83, 916 changing the Agreement obligation from $94,756 to $178,672, with the term remaining July 1, 2002 through June 30, 2005; and

 

WHEREAS, the City of San Carlos should be considered a sole source provider as there is only one shuttle service available in the City of San Carlos, which is PCA and all billing for PCA is administered by the City of San Carlos and, further, the City of San Carlos, through PCA, is presently providing shuttle services which would otherwise be interrupted if the County were to request proposals for the provision of such services. Therefore, it is in the County’s best interest to continue to contract with the City of San Carlos and waive the Request For Proposal (RFP) process [as it has done with the original agreement and prior amendments thereto; and

 

WHEREAS, this Board has been presented with a form of such Third Amendment to the Agreement and said Board has examined and approved same as to both form and content and desires to enter into the same, and has determined that it is in the best interests of the County to waive the RFP process.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Third Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

 

BE IT FURTHER DETERMINED AND ORDERED that, because the provider is deemed a sole source provider and in order to insure that there are no interruptions in service, the RFP process is hereby waived with the respect to the services to be provided pursuant to the Third Amendment to the Agreement with the City of San Carlo through June 30, 2005.
