Annexation of Property to the Emerald Lake Heights Sewer Maintenance District - Lands of Evans – Redwood City Area

 

Recommendation

Acting as the governing board of the Emerald Lake Heights Sewer Maintenance District and after conducting the public hearing:

 

1.

Adopt a resolution ordering the annexation of the Lands of Evans to the Emerald Lake Heights Sewer Maintenance District (District) and authorizing the President of the Board to execute Supplemental Agreement No. 35 to the “Agreement for Sewage Transmission, Treatment and Disposal of Sanitary Sewerage By and Between the City of Redwood City, the County of San Mateo and the Emerald Lake Heights Sewer Maintenance District” (Transmission Agreement).

 

2.

Instruct the Clerk of the Board to transmit a copy of the resolution ordering annexation, along with the executed duplicate original of Supplemental Agreement No. 35, to the City of Redwood City.

Your Board authorizing the proposed annexation can result in the District providing sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

Background

Previous Board Action

1.

Entered into an agreement with the City of Redwood City for the provision of sewer service by the District for properties within the corporate limits of Redwood City, but adjacent to District owned and operated facilities.

Set 9:00 a.m. on Tuesday, May 17, 2005, in your Chambers, as the time and place of a public hearing to consider the annexation of the Lands of Evans to the District.

 

History

Darin J. Evans and Tamara A. Evans, current owners of the property located within Redwood City at 653 East View Way and identified by Assessor’s Parcel Number 068-120-270, have requested that their property be annexed to the District for the purpose of receiving sewer service.

   

The City of Redwood City/District Transmission Agreement requires properties within the City that will be served by the District, to be annexed to the District.

   

A public hearing to consider an annexation to the District is required pursuant to Section 4860 et seq. of the Health and Safety Code.

 

Discussion

The public hearing to consider the proposed annexation has been properly noticed and the appropriate description prepared.

 

A resolution and agreement have been approved as to form by County Counsel and the City has consented to the proposed annexation and has executed Supplemental Agreement No. 35 to the Transmission Agreement.

The District is able to provide sewer service to the property. Therefore, we are recommending that the annexation be approved.

 

Fiscal Impact

The property owner has paid all required fees for each parcel as follows:

The property owner will be subject to the annual sewer service charge in the District (currently $328 per year), and will provide and pay for any necessary sewer main or sewer lateral needed to connect the property to the District’s facilities.

 

There is no impact to the General Fund.
