RESOLUTION IN SUPPORT OF SB 1018 (SIMITIAN) AND AB 1605 (WOLK) REGARDING ELDER AND DEPENDENT ADULT ABUSE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, financial abuse of elderly and dependant adults is a growing problem with only 1 in 100 cases being reported; and
|
|
WHEREAS, in San Mateo County, financial abuse is the most frequently reported abuse committed against seniors and dependant adults with 243 cases reporting in 2004; and
|
|
WHEREAS, financial institutions like banks and credit unions, which have regular contact with elderly and dependant adult customers, are in the best position to witness financial abuse through bank tellers and other financial institution employees who facilitate transactions; and
|
|
WHEREAS, SB 1018 and AB 1605 would make bank and credit union employees mandated reporters of suspected financial abuse against elderly and dependant adults and would impose civil penalties for failures to make such reports; and
|
|
WHEREAS, SB 1018 and AB 1605 also provide liability protections to financial institutions mandated reporters that mistakenly report instances of financial abuse; and
|
|
WHEREAS, SB 1018 and AB 1605 would help San Mateo County ensure basic health and safety for all and work toward Visioning 2010 Goal #8—to help vulnerable people—the aged, disabled, mentally ill, at-risk youth and others—achieve a better quality of life;

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors by adoption of this resolution does hereby support SB 1018 and AB 1605.
