Resolution Authorizing Execution of a Core Natural Gas and Aggregation Agreement with ABAG POWER, a Joint Powers Authority of the Association of Bay Area Governments

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County has previously contracted with ABAG POWER, a Joint Powers Authority of the Association of Bay Area Governments, that provides for the bulk purchase of natural gas on behalf of the County of San Mateo; and

WHEREAS, said previous contract is scheduled to expire on June 30, 2005; and

WHEREAS, ABAG POWER has requested that a new agreement be entered into with a three-year rolling term in order to allow ABAG POWER to enter into three-year fixed price gas purchase contracts to “lock in” reasonable gas prices; and

WHEREAS, the Director of Public Works has recommended that an agreement be executed that:

a)

supercedes the previously executed agreement between ABAG POWER and the County; and

b)

specifies the term of the County’s participation in the bulk purchasing of natural gas as three years, renewable every year thereafter until notice of termination by either the County or ABAG POWER is tendered as provided by said agreement; and

WHEREAS, this Board has considered and concurs in with the recommendation of the Director of Public Works.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

The President of this Board of Supervisors shall be, and is hereby, authorized and directed to execute said Agreement on behalf of the County of San Mateo and the Clerk of this Board shall attest to the signature of the President thereto.

2.

The Facilities Deputy Director of Public Works is hereby appointed as the County’s representative on the ABAG POWER Board of Directors.
