Lease Agreement Authorization

 

RECOMMENDATION:

Adopt a resolution authorizing the Sheriff to execute a short-term lease agreement to provide space to conduct a confidential and multi-jurisdictional criminal investigation.

This agreement will enhance public safety by providing a work space for a collaborative, large scale, multi-jurisdictional investigation .

 

BACKGROUND:

Since January 2005, personnel from the Sheriff’s Office have been working collaboratively with investigators from a variety of local, state and federal law enforcement agencies to gather intelligence and evidence to support the criminal prosecution of those involved in felonious criminal enterprise in San Mateo County and the surrounding Bay Area. Recently, the agencies have agreed to commit their personnel to a task force, in which the agencies’ personnel will be committed to the investigation on a full time basis.

DISCUSSION:

The Sheriff’s Office has taken a leadership role in the task force and supports the need for an adequate and secure worksite. It is necessary for the investigators to work closely together for the purpose of securely, effectively, and efficiently conducting this investigation. After extensive efforts and consultation with the County Real Property Manager, it has been determined that County Office space will not meet the needs of the task force.

The Sheriff’s Office has continued to work with the County’s Real Property Manager, and has located suitable office space to support the task force investigation in San Mateo County, and would like to enter into a contract/lease with the landlord. The term of the lease is expected to be between 12 and 18 months, and it will have flexibility for early termination or extension in the event investigation concludes earlier or continues longer than expected.

The Sheriff’s Office is requesting the Board of Supervisors to authorize the Sheriff to enter into a lease with landlord, subject to the County Counsel’s review of the form of the lease, and with a cap on the maximum lease term and amount.

 

FISCAL IMPACT:

The Sheriff’s Office has established a special operations budget to manage and fund this project during FY 2005/2006. This lease is part of the budget, and it is expected that the cost will be approximately $33,000 a year. It is requested that the Board grant contracting authority for a term of 18 months, and an amount not-to-exceed $50,000 for that period.

The other law enforcement agencies participating in the task force are making significant financial contributions and staff assignments to the investigation.
