RESOLUTION AUTHORIZING SUBMISSION OF GRANT APPLICATION TO CALIFORNIA DEPARTMENT OF INSURANCE FOR THE DISTRICT ATTORNEY PROGRAM FOR INVESTIGATION AND PROSECUTION OF AUTOMOBILE INSURANCE FRAUD

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo desires to maintain its program for Investigation and Prosecution of Automobile Insurance Fraud to be funded, in part, from funds made available through the California Insurance Code Section 1872.8, California Code of Regulation Subchapter 9, Article 4, Section 2698.65 and administered by the California Department of Insurance (hereinafter referred to as DOI);

WHEREAS, it is agreed that the State of California and DOI disclaim any responsibility for any liability, and that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency;

WHEREAS, it is agreed that any grant funds received hereunder shall not be used to supplant expenditures controlled by this body;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the District Attorney of the County of San Mateo, on behalf of the Board of Supervisors, is authorized to submit this grant application to DOI, and is authorized to execute the Grant Award Agreement including any extensions or amendments thereof which do not require commitment of County funds.
