Second Amendment to the Agreement with the Peninsula Community Foundation

 

RECOMMENDATION:

Adopt a resolution:

 

1.

Waiving the Request for Proposal Process; and

2.

Authorizing the execution of a Second Amendment to the Agreement with Peninsula Community Foundation for the purpose of transferring funds from the Maple Crossing Child Care Center Project into the Child Care Facilities Expansion Fund and to extend the term of the Agreement from June 30, 2005 to June 30, 2008. There is no change in the amount of the Agreement, which is currently $1,350,000.

* FCCHs is an abbreviation for family child care homes.

 

The number of projected family child care home (FCCH) applicants is based on the current rate of applications. The decrease is related to a reduction, as of January 2005, in the number of funding rounds per year (from four to two), and the corresponding limitation of outreach efforts. This change in the program’s application process is designed to maintain the caseload of grantees at a level consistent with staff capacity.

 

All applications are expected to be approved, given: (1) previous program experience, and (2) an outreach process and associated technical assistance that seeks to assure that all candidates meet eligibility guidelines prior to applying. The projections assume that the program is funded at current levels through FY 2007-08.

 

BACKGROUND:

On May 22, 2001 the Board of Supervisors approved Resolution Number 64466 authorizing the execution of an Agreement with Peninsula Community Foundation (“PCF”) pursuant to which PCF would administer funds for the purpose of purchasing furnishings and equipment and for start-up expenses of the Maple Crossing Child Care Center. The original Agreement was for $350,000.

 

This Agreement was amended on March 26, 2002, by Resolution Number 65131 to increase funds by $1,000,000 for the purposes of contributing to the Child Care Facilities Expansion Fund (the “Fund”). The Fund is a project of the Child Care Coordinating Council of San Mateo County, Inc. It is one of four Countywide efforts to increase the number of licensed child care spaces in San Mateo County, which has been advocated by the Countywide Child Care Action Campaign, and endorsed by the Board of Supervisors.

 

DISCUSSION:

This Second Amendment transfers funds from the Maple Crossing Child Care Center Project to the Fund and extends the term of the Agreement so that further projects can be developed. Implementation plans for the Maple Crossing Child Care Center Project were not completed and funds remain unspent. Interest earned on the original amount of $350,000 brings the current total amount to approximately $370,655.07. In addition the Fund has unspent funds in the amount of $394,203.16. Transfer of funds from the Maple Crossing Child Care Project to the Fund will result in a net amount of $764,858.23 remaining allocated to this Agreement. The Fund will use these monies to develop new child care centers, expand existing centers in San Mateo County.

 

The Board of Supervisors is being asked to waive the RFP process as PCF is the sole source provider with respect to the administration of monies to the Fund and the Fund is a project of the Child Care Coordinating Council of San Mateo County, Inc., which provides the unique service of developing child care facilities in San Mateo County. County Counsel has approved this Amendment as to form and Risk Management has approved Contractor’s insurance.

 

FISCAL IMPACT:

The amount of this Agreement remains $1,350,000 and the term is extended to May 1, 2001 through June 30, 2008. The Agreement is funded 100% by CalWORKs incentive funds. The funds have already been advanced; therefore there is no appropriation in the Agency’s budget for FY 2005-06.
