RESOLUTION AUTHORIZING THE SECOND AMENDMENT TO THE AGREEMENT WITH PENINSULA COMMUNITY FOUNDATION AND WAIVING THE REQUEST FOR PROPOSAL PROCESS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on May 22, 2001, the Board of Supervisors approved resolution 64466 authorizing the execution of an Agreement with Peninsula Community Foundation (“PCF”) pursuant to which PCF would administer funds for the purpose of purchasing furnishings and equipment and for start-up expenses of the Maple Crossing Child Care Center in the amount of $350,000.

 

WHEREAS, on March 26, 2002, the Agreement was amended pursuant to Resolution Number 065131 to increase funds by $1,000,000 for the purposes of contributing to the Child Care Facilities Expansion Fund (the “Fund”), which was endorsed by the Board of Supervisors; and

 

WHEREAS, the plans to build the Maple Crossing Child Care Center were not implemented and the funds from this project remain unspent; and

 

WHEREAS, the County and Contractor wish to further amend the Agreement in order to transfer such funds into the Child Care Facilities Expansion Fund for a total contribution of $1,350,000 with no net cost difference to the Agreement and extend the term from May 1, 2001 through June 30, 2005 to May 1, 2001 through June 30, 2008; and

 

WHEREAS, The Board of Supervisor is being asked to waive the RFP process as PCF is the sole source provider with respect to the administration of HSA monies to the Fund and the Fund is a project of the Child Care Coordinating Council of San Mateo County, Inc., which provides the unique service of developing child care facilities in San Mateo County; and

 

WHEREAS, This Board has been presented with a form of such Second Amendment to the Agreement and has examined and approved same as to both form and content and desires to enter into the same, and determines it is in the best interest of the County to waive the RFP process.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Second Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

 

BE IT FUTHER DETERMINED AND ORDERED that the RFP Process is hereby waived in regards to the Second Amendment.
