Resolution Authorizing a Road Fund Budget Set-Aside for the Reclamation of Pescadero Quarry

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, San Mateo County, as owner of the Pescadero Quarry, is obligated pursuant to the State Surface Mining and Reclamation Act to complete the reclamation of the Pescadero Quarry; and

 

WHEREAS, an assurance is required to guarantee the reclamation plan will be completed, and said assurance must meet the requirements of the Surface Mining and Reclamation Act (Public Resources Code Section 2710 et seq.); and

 

WHEREAS, Section 3806.2 of Title 14 of the California Code of Regulations provided that a specific fund or line item set aside will meet the requirements of the Section 2773.1 of the Public Resources Code.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The Director of Public Works is hereby authorized to set aside $25,000 in the Road Fund Budget in a Contingency Line Item for Fiscal Year 2005-2006 for the subsequent Fiscal Years if necessary, for the expressed purpose of providing assurances that the reclamation of the Pescadero Quarry will be implemented.

This Board shall consider authorizing the County’s Environmental Services Agency, as the lead agency for the State, to expend the funds set aside in the Road Fund Contingency, as necessary to complete the work contemplated by said reclamation plan, upon the presentation of evidence and confirmation by this Board that the Department of Public Works is incapable of performing the reclamation work guaranteed by the assurance in the Road Fund Contingency.
