Third Amendment to the Agreement with Sam Trans

 

RECOMMENDATION:

Adopt a resolution authorizing the execution of a Third Amendment to the Agreement with Sam Trans increasing the amount by $61,990, correcting the amount and fiscal portion of the Agreement. The term remains June 1, 2002 through June 30, 2005.

The Agreement with Sam Trans contributes to this commitment and goal by providing a safe mode of transportation to the community and accessibility to programs and services.

*In FY 2003-04 Sam Trans shuttled an average of 5,400 commuters. FY2004-05 it is anticipated that Sam Trans will have shuttled 6,000 commuters, which is an increase of 9% from the past fiscal year.

 

BACKGROUND:

The Agreement between the Human Services Agency (HSA) and Sam Trans currently provides transportation to East Palo Alto residents, to and from the Caltrain station and to the HSA’s One-Stop Center in Menlo Park and to other community service agencies in the area. The need to have transit service linked to the One-Stop Center and other community service agencies was expressed by the community.

 

DISCUSSION:

This Third Amendment corrects the amount and fiscal portion of the Agreement. Sam Trans was to receive $60,000 for each of the following fiscal years: FY 2002-03, FY 2003-04 and FY 2004-05. The Second Amendment extended the Agreement to June 30, 2005 and increased the amount only by $20,783, which was an error.

 

This Contractor is the only shuttle provider for the East Palo Alto area and should therefore be considered a sole source provider. County Counsel has approved this Amendment as to form and Risk Management has approved the Contractor’s insurance.

 

FISCAL IMPACT:

This Third Amendment increases the contract obligation by $61,990 for a total Agreement obligation of $180,000. Of the $61,990, $1,990 is for services provided in FY 2003-04 and the balance of $60,000 is for services for FY 2004-05. Costs are fully funded with the LIFT grant. There is enough appropriation in the FY 2004-05 Adopted Budget for this total increase in obligation. There is no Net County Cost.
