Revisions to the Miscellaneous Parking, the No Parking During Specified Hours and the No Parking Sections of Title 7, Vehicle and Traffic, of the San Mateo County Ordinance Code

 

Recommendation

A.

Adopt an ordinance:

 
 

1.

amending Section 7.28.010 and 7.28.020 of the Ordinance Code to define Miscellaneous Parking Regulations and signs and markings used for designating parking zones in the unincorporated area;

 
 

2.

adding a new Chapter 7.30, “No Parking Zones,” and Ordinance Code Section 7.30.010 to define no parking zones and to provide that said zones will be established by Board resolution;

 
 

3.

amending Chapter 7.32, “No Parking During Specified Hours Zones,” and Section 7.32.010 to define no parking during specified hours zones and to provide that said zones will be established by Board resolution; and

 
 

4.

Repealing Sections 7.28.060 through 7.28.090; Sections 7.28.120 through 7.28.150; Sections 7.28.240 through 7.28.270; and Sections 7.32.020 through 7.32.2030; which will eliminate the listing of streets in the Ordinance Code which have miscellaneous parking restrictions, no parking zones or no parking zones during specified hours.

 

B.

Adopt resolutions:

 

1.

Re-designating existing no parking zones, that were previously approved by Ordinance and adding new no parking zones in the Broadmoor Village area as requested by the Broadmoor Police Department; and

 
 

2.

Re-designating existing no parking during specified hours zones, that were previously approved by Ordinance, and adding no parking during specified hours zones on portions of Edgewood Road near Interstate 280 (I280).

Your Board’s adoption of the proposed ordinances and resolutions will allow us to:

 

a.

streamline Ordinance Code Sections 7.28 and 7.32, et. seq.; and

 

b.

maintain alphabetic listings of approved parking zones that can be easily updated and made available to the public.

 

Background

Previous Board Action

Adopted Ordinance No. 4262 which streamlined the Disabled Parking Zone regulations in the County Ordinance Code by providing that said zones may be established by resolution of your Board.

 

History

No Parking and Miscellaneous Parking zones that are approved are currently codified in chronological order in Sections 7.28 and 7.30 of the County Ordinance Code. Existing parking ordinances date back to 1949, and include areas that are no longer unincorporated.

 

Discussion

Section 22506 of the California Vehicle Code provides that local authorities may prohibit or restrict the stopping, parking or standing of vehicles by resolution or ordinance. We are recommending that parking regulations for streets and portions of streets within the unincorporated area of the County, and for County owned property where parking regulations are established, be approved by resolution of your Board and that they no longer be listed in the Ordinance Code. The location of parking restrictions on County maintained streets are currently documented on GIS maps in the Department of Public Works, and will be made available in list form on the Department’s web site.

 

Three (3) no parking zones have also been included in the proposed resolution at the request of the Broadmoor Police Department. These zones will restrict parking adjacent to driveways on Sylvan and Villa Streets in the Broadmoor area.

 

Three (3) no parking during specified hours zones have also been included in the proposed resolution at the request of Supervisor Gordon. These zones will prohibit the overnight storage of vehicles in the scenic corridor along Edgewood Road near I280 and west of I280 by prohibiting parking between the hours of 7:00 p.m. and 7:00 a.m. Supervisor Gordon’s staff received complaints that this area of Edgewood Road is being used for the long-term parking of construction-type vehicles, which is an inappropriate use in the scenic corridor. The Sheriff has reviewed the areas and believes that no parking during specified hours zones are appropriate.

 

Ordinances and resolutions have been approved as to form by County Counsel. We will, as stated previously, maintain the list of approved parking regulations on the Department of Public Works’ web site.

 

Fiscal Impact

The cost of the staff time involved in evaluating and processing requests for parking regulations is part of the administrative costs associated with evaluating traffic-related requests involving the County maintained road system, and is financed with Road Funds. The cost of signing and marking parking zones varies, but averages out to approximately $500 per zone. This cost is also financed with Road Funds.

 

Ordinance Code revisions are compiled and published by County Counsel and the cost of this work is financed with General Funds. We believe that there will be a savings of approximately $2,100 per year to the General Fund as updates to this section of the Ordinance Code will no longer have to be published each time a new no parking zone is approved or eliminated. The $2,100 saving is based on eliminating fourteen (14) pages from the Ordinance Code and the estimate provided by County Counsel that it costs approximate $150 per page to publish and distribute Ordinance Code supplements each year.
