RESOLUTION AUTHORIZING A THIRD AMENDMENT TO THE FY 2004-05 AGREEMENT WITH O’RORKE, INC. EXTENDING THE TERM OF THE AGREEMENT FROM JUNE 30, 2005 TO JANUARY 31, 2006

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on April 8, 2003 the Board of Supervisors approved an Agreement with O’Rorke, Inc., for the purpose of providing tobacco social marketing and media services; and

WHEREAS, on August 2, 2003, a First Amendment to the Agreement clarified the rate of payment from funding sources shown in the Agreement; and

WHEREAS, on June 29, 2004 a Second Amendment extended the term of the Contract and increased the funding by $62,328 to the total obligation of $227,328; and

WHEREAS, it is now the mutual desire and intent of the parties hereto, to amend and clarify the Agreement with O’Rorke, Inc. by extending the term of this Agreement by seven (7) months from June 30, 2005 to January 31, 2006. The total obligation of $227,328 will remain the same, and there is no Net County Cost associated with this Amendment.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.
