Annexation of Property to the Fair Oaks Sewer Maintenance District - Lands of Andersson and Flowers – Woodside Area

 

Recommendation

Acting as the governing board of the Fair Oaks Sewer Maintenance District, and after conducting the public hearing:

 

1.

Adopt a resolution ordering the annexation of the Lands of Andersson and Flowers to the Fair Oaks Sewer Maintenance District (District).

 

2.

Instruct the Clerk of the Board to transmit a copy of the resolution ordering annexation to the Town of Woodside.

Your Board authorizing the proposed annexation can result in the District providing sanitary sewer service to a parcel in a suburban area that would otherwise use an “on-site” method to handle wastewater, which could have an impact on neighboring residents.

 

Background

Previous Board Action

1.

Entered into an agreement with the Town of Woodside for the provision of sewer service by the District for properties within the corporate limits of Woodside, but not within the current boundaries of the District.

Set 9:00 a.m. on Tuesday, July 26, 2005, in your Chambers, as the time and place of a public hearing to consider the annexation of the Lands of Andersson and Flowers to the District.

 

History

Theodore M. Andersson and Nancy M. Flowers, whose property is at 124 Jane Drive and identified by Assessor’s Parcel Number 073-012-030, have requested that their property be annexed to the District for the purpose of receiving sewer services.

 

Their existing septic system has failed and they received a letter from the Office of Environmental Health permitting them to expedite a connection.

 

A public hearing to consider an annexation to the District is required pursuant to Section 5820 et. seq. of the Streets and Highways Code.

 

Discussion

The public hearing to consider the proposed annexation has been properly noticed and the appropriate description prepared.

 

A resolution and agreement have been approved as to form by County Counsel and the Town has consented to the proposed annexation by execution of Town Resolution No. 2005-6499.

 

The District is able to provide sewer service to the property. Therefore, we are recommending that the annexation be approved.

 

Fiscal Impact

The property owner has paid the required fees which include:

The State Board of Equalization's Recording and Mapping Fee:

Sewer Inspection Permit Fee:

The property owner will be subject to the annual sewer service charge in the District, currently $247 per year, and will provide and pay for any necessary sewer main or sewer lateral needed to connect the property to the District’s facilities.

 

There is no impact to the General Fund.
