RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE LESLEY FOUNDATION IN THE AMOUNT OF $151,000 FOR A CDBG FUNDED FACILITY IMPROVEMENT LOAN (SPRINKLER SYSTEM INSTALLATION AND RELATED SERVICES), AT BONNIE BRAE TERRACE, 2400 CARLMONT DRIVE, BELMONT, CA, FOR THE TERM OF 7/1/2005 THROUGH 6/30/2006, AND AUTHORIZING THE DIRECTOR OF THE DEPARTMENT OF HOUSING TO EXECUTE SUBSEQUENT AMENDMENTS TO THE AGREEMENT, AND TO MAKE MINOR MODIFICATIONS IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED BY THE LESLEY FOUNDATION UNDER THE AGREEMENT, AND THE CUMULATIVE COST OF WHICH AMENDMENTS AND MODIFICATIONS IS NOT TO EXCEED $25,000

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, under Agreement # 066792 (“Original Agreement”), the County of San Mateo and The Lesley Foundation (“Contractor”) entered into an Agreement for a Facility Improvement (Sprinkler System Installation and related services) Loan, for Bonnie Brae Terrace, at one of three building located at 2400 Carlmont Drive, Belmont, CA; and

 

WHEREAS, Contractor under First Amendment # 067149 to the Original Agreement received additional funding in the amount of $101,185 for a total of $266,185, to provide for a Facility Improvement (sprinkler system installation and related services) Loan for the third of three buildings, at Bonnie Brae Terrace, 2400 Carlmont Drive in Belmont. The Original Agreement as amended by the First Amendment is hereinafter referred to as the “Amended Agreement”; and

 

WHEREAS, On May 3, 2005, the Board of Supervisors approved Contractor to receive an additional loan in the amount of $151,000 from CDBG funds for FY 2005-06, to cover the expenses to replace a standpipe, which was an unanticipated requirement necessary to comply with the applicable local fire code for Bonnie Brae Terrace, 2400 Carlmont Drive in Belmont; and

 

WHEREAS, both parties now wish to enter into an Agreement, to provide $151,000 from CDBG for the Facility Improvement Loan, at Bonnie Brae Terrace, 2400 Carlmont Drive, Belmont, CA, for the period of 7/1/2005 to 6/30/2006, for a total obligation of $151,000; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Agreement between the County of San Mateo and The Lesley Foundation, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

 

NOW THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

 

BE IT FURTHER RESOLVED, that the Director of the Department of Housing shall be authorized to execute subsequent amendments to the Agreement, and to make minor modifications in the types of services and activities provided by The Lesley Foundation under the Agreement, the cumulative cost of which amendments and modifications is not to exceed $25,000.
