Resolution Rejecting Bids and Authorizing the Director of Public Works to
Re-Advertise the Construction of the Tarwater Creek Sediment Reduction Project for Bid (F-282 [2C])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on June 7, 2005, adopt Resolution No. 67349, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for sealed proposals for the Tarwater Creek Sediment Reduction Project (Project); and

WHEREAS, the Clerk of this Board of Supervisors did receive one sealed proposal for doing of the work referred to in said Resolution No. 67349 on June 28, 2005; and

WHEREAS, the only bid received for the Project is substantially more than the Engineer’s estimate; and

WHEREAS, Section 22038 of the Public Contract Code provides that a public agency may, at its discretion, reject all bids as presented and re-advertise the same work for bids; and

WHEREAS, the Director of Public Works has recommended that the bid be rejected and that the Director of Public Works be authorized to re-advertise the project for bid; and

WHEREAS, this Board has considered and concurs in the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The bid received on June 28, 2005 is hereby rejected.

2.

The Director of Public Works is hereby authorized to re-advertise the project for bid as provided by Section 22038 of the Public Contract Code.
