Resolution Relieving the Low Bidder of Their Bid, Rejecting all Bids Received and Authorizing the Director of Public Works to Re-Advertise the Reconstruction of Ninth Avenue for Bids – North Fair Oaks Area (Project No. RD100, F-36 [305-1B])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on June 21, 2005, adopt Resolution No. 067385, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for the sealed proposals for the reconstruction of Ninth Avenue; and

 

WHEREAS, the Clerk of this Board of Supervisors did, in public on July 12, 2005, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 067385; and

 

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo; and

 

WHEREAS, the Director of Public Works has determined that the low bidder made an error in their bid; and

 

WHEREAS, the low bidder, Half Moon Bay Paving and Grading Inc., has requested that they be relieved of their bid as provided by Section 5101 et. sec. of the Public Contract Code, on the basis of their having made an error in their bid proposal; and

 

WHEREAS, the Director of Public Works has reviewed the bid of the low bidder and is satisfied that their error was legitimate and is recommending that they be relieved from their bid; and;

 

WHEREAS, Section 22038 of the Public Contract Code provides that a public agency may, at its discretion, reject all bids as presented and re-advertise the same work for bids; and

 

WHEREAS, the Director of Public Works has recommended that all bids originally received for said work be rejected and that the Director of Public Works be authorized to re-advertise the project for bid; and

 

WHEREAS, this Board has considered and concurs in the recommendations of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

Half Moon Bay Grading and Paving, Inc. is hereby relieved of its bid submitted on July 12, 2005; and

 

2.

All bids received on July 12, 2005, for said work are hereby rejected; and

 

3.

The Director of Public Works is hereby authorized to re-advertise the project for bids as provided by Section 22038 of the Public Contract Code.
