RESOLUTION AUTHORIZING SUBMISSION OF GRANT APPLICATION TO THE CALIFORNIA OFFICE OF EMERGENCY SERVICES FOR THE DISTRICT ATTORNEY STATUTORY RAPE PROSECUTION PROGRAM

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo desires to maintain a certain program designated the Statutory Rape Prosecution Program to be funded, in part, from funds made available through the Statutory Rape Prosecution Program and administered by the California Office of Emergency Services (hereinafter referred to as OES);

WHEREAS, it is acknowledged that, as a condition to receiving monies from the OES, the State of California and OES require each grant recipient to execute a Grant Award Agreement and further require that each grant recipient and the authorizing agency accept responsibility for any liability arising out of its performance of the Grant Award Agreement, including civil court actions for damages;

WHEREAS, it is acknowledged that the State of California and OES disclaim any responsibility for any liability arising out of a grant recipient’s performance of the Grant Award Agreement;

WHEREAS, it is agreed that any grant funds received hereunder shall not be used to supplant expenditures controlled by this body;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the District Attorney of the County of San Mateo, on behalf of the Board of Supervisors, is authorized to submit this grant application to OES, and is authorized to execute the Grant Award Agreement including any extensions or amendments thereof which do not require commitment of County funds.
