RESOLUTION AUTHORIZING EXECUTION OF A JOINT POWERS AGREEMENT TO FORM THE SAN MATEO COMMUNITY HEALTH AUTHORITY, AND CONSENTING TO THE ASSIGNMENT OF CERTAIN CONTRACTS BETWEEN THE COUNTY OF SAN MATEO AND THE HEALTH PLAN OF SAN MATEO

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors for its consideration and approval a Joint Powers Agreement pursuant to Government Code §§6500 et seq., whereby the County and the San Mateo Commission on Publicly Assisted Medical Care (Health Commission, dba Health Plan of San Mateo) will form the San Mateo Community Health Authority JPA; and

WHEREAS, this Board has examined said agreement as to form and content and desires to enter into the said Joint Powers Agreement; and

WHEREAS, the Health Plan of San Mateo has requested the County of San Mateo’s consent to the assignment of several county contracts to the San Mateo Community Health Authority JPA, specifically, the master contract for the Health Plan of San Mateo to administer the County’s Healthy Kids programs, and the provider contracts whereby the County of San Mateo provides non-Medi-Cal health care services to Health Plan members; and

WHEREAS, the Health Plan of San Mateo has requested the Board of Supervisors, acting as the IHSS Public Authority, to consent to the assignment of the HealthWorx contract to the San Mateo Community Health Authority JPA; and

WHEREAS, the County has reviewed said assignments and wishes to consent to the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Joint Powers Agreement between the County of San Mateo and the Health Plan of San Mateo is hereby approved, and the President of this Board of Supervisors is hereby authorized and directed to execute the aforesaid Agreement as approved by the County Manager and County Counsel for and on behalf of the County of San Mateo, and the Clerk of the Board shall attest the President’s signature thereto. Nonmaterial changes to the agreement may be made by the County Manager with the written consent of County Counsel.

BE IT FURTHER RESOLVED, that the County of San Mateo hereby consents to the Health Plan of San Mateo’s assignment of the following contracts between the County of San Mateo and the Health Commission to the San Mateo Community Health Authority JPA:

1) the master agreement for the Health Plan of San Mateo to administer the Healthy Kids program; and

2) all contracts whereby the County of San Mateo provides non-Medi-Cal health to services members of the Health Plan of San Mateo.

BE IT FURTHER RESOLVED, that in its capacity as the IHSS Public Authority, the Board of Supervisors of the County of San Mateo hereby consents to the assignment of the IHSS Authority’s HealthWorx contract to the San Mateo Community Health Authority.
