Resolution Authorizing Execution of an Agreement with a California Limited Partnership Known as Eighty-One Amherst Avenue, for Improvements at
81 Amherst Avenue – Redwood City Area


RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that


WHEREAS, the Director of Public Works has recommended that an agreement be entered into with Eighty-One Amherst Avenue, A California Limited Partnership, hereinafter called “Developer,” for the construction of on-site road, drainage and utility facilities that Developer will be constructing at 81 Amherst Avenue in conjunction with the proposed subdivision of said property; and.


WHEREAS, the agreement provides that the Developer will file with the Director of Public Works, a Letter of Credit in the amount of $260,000 to secure the performance of said improvements, in the amount of $130,000 to secure payment for labor and materials, and in the amount of $26,000 to guarantee and warranty the work for one year following the completion and acceptance of said improvements, all in accordance with Chapter 5 of the Subdivision Map Act; and


WHEREAS, Developer had also paid an inspection deposit to the Department of Public Works to cover the actual costs incurred by the County for regular and final inspections of the subdivision improvements in accordance with Section 7035 of the County of San Mateo Subdivision Regulations; and


WHEREAS, this Board has considered the agreement and the recommendation of the Director of Public Works and concurs in the Director’s recommendation.


NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that said agreement by and between the County of San Mateo and Developer, is hereby approved, and the President of this Board is hereby authorized to sign same for and on behalf of the County of San Mateo and the Clerk of the Board shall attest to the President’s signature thereto.
